It only works if a company in Guatemala puts you on its payroll. Local salaries decide whether that makes sense for an American.

  • The 2026 minimum wage for non-farm work in Guatemala department is about $524 a month (Q4,002.28).
  • Bilingual call-center listings ran about $720 to $1,080 a month (Q5,500 to Q8,244) in September 2026.
  • Managers, directors and superintendents are exempt from the 90% rule, so senior hires and company transfers fit well.
  • Hired by a government agency? You skip the guarantor and file only an offer signed by its HR head.

What your employer puts on the line

A signed offer letter

Addressed to you, stating the job, hours, term, pay, start date and workplace. IGM sets your residence length partly by the offer's term, up to five years.

Guarantor registration

The company registers with IGM as your garante, answers jointly for you and any dependents, and renews that registration every year.

Your work permit

Filed with the Labor Ministry (MINTRAB). The government's procedures catalog lists it at Q3,000 with a 30-day turnaround for general permits.

Room under the 90% rule

At least 90% of its staff must be Guatemalan and earn at least 85% of payroll. The limit doesn't apply to managers and directors.

Paid from outside Guatemala?

Then you don't need a local employer. Under the 2025 rules, remote employees can qualify with bank statements showing at least $2,000 a month from abroad over the past year ($3,000 with dependents), and freelancers can file with a Guatemalan tax registration (RTU) and business authorization instead.

The process

From tourist stamp to residence card, in order

You file from inside Guatemala, and each step has a deadline. Miss one and IGM can fine you or shelve your file.

  • Arrive visa-free. Americans can stay up to 90 days as tourists.
  • File at IGM in Zone 4 of Guatemala City. An open application authorizes your stay, so no overstay builds up while you wait.
  • Answer any IGM request within 30 days, or face a fine and possible denial. Files left idle six months are archived.
  • Once approved, register at IGM within 30 days (IGM lists a $200 fine if you don't), then get your foreigner ID (DPI) at RENAP.
  • Present a valid work permit within three months of approval, then every year after.

A complete copy, showing your last Guatemalan entry stamp.

Criminal record check

From the U.S. or its embassy, or from where you lived the two years before arriving. Guatemala accepts apostilles.

Migratory movement certificate

IGM's own record of your entries and exits, showing your latest arrival.

Offer letter and guarantor certificate

Both come from your employer, and the guarantor certificate must be current.

Birth certificate for kids only

Adults from countries with an embassy in Guatemala, like the U.S., skip it. Children need one, plus both parents' notarized consent.

After approval

Family, renewals and the five-year mark

Your spouse or partner and dependent relatives can file with you for the same term, and Guatemala's Migration Code lets them work too. Your guarantor covers them as well.

  • Renew 30 days before your residence expires ($25 to file). You'll need your DPI and a clean Guatemalan police record.
  • Every year, show a tax solvency certificate and update your data with IGM.
  • Leaving for a year or more? Get IGM's written authorization first, or your residence can be canceled.
  • After five years as a temporary resident you can apply for permanent residence. Temporary status can't be extended past five years.

Guatemala worker residence: common questions

How long does Guatemalan worker residence take to approve?

IGM says a complete residence file is resolved in about 30 business days after it's submitted. Applicants report two to four months from filing in practice. The Labor Ministry lists 30 days for a general work permit, which comes after the residence is approved.

Does my Guatemalan employer have to be my guarantor?

Yes, in practice. The regulation requires a Guatemalan guarantor with an up-to-date guarantor certificate, and Guatemalan lawyers explain that for migrant workers that guarantor has to be the employer. The guarantor answers jointly for you and your dependents. People hired by Guatemalan government agencies are exempt.

Do I need a Guatemalan work permit before I apply for residence?

No. You file for residence first. The 2025 regulation gives you three months after IGM notifies you of approval to present a valid work permit from the Labor Ministry, and you present an updated permit every year. Your employer files the permit, and the permit rules accept proof that your residence application is in process.

Can Guatemalan worker residence lead to permanent residence or citizenship?

Yes to permanent residence: after five years as a temporary resident you can apply for it. Citizenship is harder. Naturalization needs five years of residence with no absence over six months in a row or a year in total, and the naturalization oath asks you to renounce your nationality of origin, so talk to a lawyer before going that far.

How much does Guatemala's temporary residence for workers cost in 2026?

IGM charges $25 to file plus a grant fee of $200 for one year, $300 for two years or $500 for three to five years, paid in quetzales. The Labor Ministry work permit is listed at Q3,000, about $393 at September 2026 rates. Each dependent files their own application, and apostilles, translations and legal help cost extra.

Do I pay income tax in Guatemala on a local salary?

Yes. Guatemala taxes income earned from work done in the country. Employees pay 5% on taxable income up to Q300,000 a year (about $39,300) and 7% above that, withheld monthly by the employer, after a deduction of up to Q60,000. Social security (IGSS) takes another 4.83%. You still file a U.S. return, and the 2026 foreign earned income exclusion covers up to $132,900 if you qualify.

Can my spouse work in Guatemala if I have worker residence?

Yes. Guatemala's Migration Code lets the spouse, partner and dependent relatives of a migrant worker live in the country while the job lasts, and allows them to work by taking on migrant-worker status. They apply for the same term and status as you and can file at the same time.

Can I apply for Guatemalan temporary residence after entering as a tourist?

Yes. Americans enter Guatemala without a visa and can stay up to 90 days as tourists. Under the 2025 residence regulation, filing a temporary residence application authorizes you to stay while IGM processes it, so you don't accrue overstay during that time. Answer any request from IGM within 30 days, or you can be fined and denied.
