Hired in Guatemala: the work permit and residence you'll actually need

Guatemala has no separate specialized-worker visa. A job offer, a local guarantor and two government approvals are what get you in.

This route is for people with a real offer from a company in Guatemala. Your employer handles the work permit, you handle residence with the immigration institute (IGM), and both renew on their own clocks. If your paycheck comes from the U.S., skip to the last section.

How the route works

A job offer, a guarantor, then two approvals

Guatemala's 2025 residence rules (IGM-016-2025) list migrant workers as a temporary residence category. Specialist skills don't go in your file. They matter for your employer's staffing quota, covered below.

  • An original job-offer letter naming the position, hours, term, pay, start date and workplace
  • A Guatemalan guarantor with a current guarantor certificate
  • Your passport and a U.S. criminal-record certificate, apostilled and translated into Spanish
  • A work permit from the Ministry of Labor, filed by your employer

Step by step

Residence comes first, the permit follows

Order matters. IGM decides your residence, and the work permit has to be presented within three months of that decision.

  • Get the offer letter with all six details IGM wants, and line up your Guatemalan guarantor.
  • Apostille your U.S. documents (Guatemala has accepted apostilles since September 2017) and get them translated into Spanish.
  • Enter Guatemala visa-free. Tourists can stay up to 90 days, and that allowance is shared with El Salvador, Honduras and Nicaragua.
  • File with IGM from inside the country. The file includes a certificate showing your last entry into Guatemala.
  • Once residence is approved, your employer files the permit online and pays Q3,000 at the bank within 5 business days.
  • Renew the permit in writing at least 15 days before it lapses. Don't start work until it's in hand.

The 90/85 rule your employer has to meet

Guatemala's Labor Code requires employers to keep at least 90% Guatemalan staff and pay them at least 85% of total payroll. With five or fewer workers, four must be Guatemalan. Managers, directors and general heads are exempt, and the rule can be relaxed where Guatemalan technicians are lacking. That's where specialist skills count.

Check the local pay

Guatemala's 2026 minimum for non-farm work in Guatemala Department is Q4,252.28 a month with the incentive bonus, about $557. Get your salary in writing.

Guatemalan income tax

Your employer withholds 5% on taxable pay up to Q300,000 a year (about $39,300) and 7% above that. The first Q48,000 (about $6,300) is exempt.

Social security

Employees pay 4.83% of salary to IGSS. The U.S. has no totalization agreement with Guatemala.

U.S. taxes still apply

You keep filing a U.S. return. The foreign earned income exclusion needs bona fide residence abroad or 330 full days out of the U.S. in 12 months.

Leaving Guatemala for more than a year without IGM's authorization can get your residence canceled.

Guatemala work permit questions

Can I apply for Guatemalan worker residence from the United States?

Plan on filing in Guatemala. The residence file includes a certificate of your last entry into the country, and Americans can enter visa-free as tourists for up to 90 days, shared across Guatemala, El Salvador, Honduras and Nicaragua.

How long is a Guatemala work permit valid?

One year. It can be renewed for another year at a time if the renewal is requested in writing at least 15 days before it expires. Temporary residence itself is granted for one to five years, and a renewal should be filed 30 days before it ends.

What happens if I leave Guatemala for a long time on worker residence?

Leaving Guatemala for more than one year without IGM's authorization, and without a justification, is grounds for canceling your residence.

Does Guatemala have a specialized worker visa?

No. Guatemala's residence rules (IGM-016-2025) don't have a specialist category. People hired by a company in Guatemala get temporary residence as migrant workers from the immigration institute (IGM), plus a work permit from the Ministry of Labor that the employer files.

Can a Guatemala worker residence lead to permanent residence?

Yes. After five or more years as a temporary resident you can apply for permanent residence, which IGM charges $700 for, plus $40 a year after that.

How much do a Guatemala work permit and worker residence cost?

IGM charges $25 to file and $200 for one year of temporary residence, $300 for two years or $500 for three to five years. The Ministry of Labor's work permit costs Q3,000 (about $393 in September 2026) and is renewed every year. Apostilles and Spanish translations of your U.S. documents are extra.

Will I pay Guatemalan income tax on a Guatemalan salary?

Yes. Your employer withholds income tax each month: 5% on taxable pay up to Q300,000 a year and 7% above that, after the first Q48,000 of salary, which is exempt. You'll also pay 4.83% to IGSS, Guatemala's social security. As a U.S. citizen you still file a U.S. return.

Can my spouse and children move to Guatemala with me?

Yes. A migrant worker's spouse or cohabiting partner and relatives within the legal degrees can hold Guatemalan residence as dependents. They can apply at the same time as you or later.
